Till 2017 a failed attempt to committ suicide was a crime.
Definition of section 309. Attempt to commit suicide. —Whoever attempts to commit suicide and does any act towards the commission of such offence, shall he punished with simple imprisonment for a term which may extend to one year 1[or with fine, or with both]
210th report of law commission of India says It should be decriminalised.
210th Law commission report is entitled as : " humanisation and decriminalisation of attempt to suicide "
Recommendation of this report says :
It should be effaced and is inhuman
In debate 1996 Gyan Kaur vs state of Punjab: It was concluded that section 309 is violating Article 21 ( right to live)
And if right to life exist then it's termination should also exist.
It was further contended In the P. Rathinam vs union of India
That Terminating by unnatural means is also not justified.
In 2017 mental health care act was proposed
In which the definition of 309 was changed
Which restricted the application of section 309.
It has just been curtailed not been decriminalised yet.
Notwithstanding anything contained in section 309 of the Indian Penal Code, any person who attempts to commit suicide shall be presumed, unless proved otherwise, to have severe stress and shall not be tried and punished under the said Code.
Means Mental health care Act has made attempt to suicide punishable with exception.That an accused has to prove that he is under conditions relating to depression and stress.
India among some countries like Pakistan, Bangladesh countries having attempt to commit suicide criminalised.
whereas large number of countries including native country i.e Srilanka have decriminalized it.
